we have a friend that has 40 acres in plumas county, northern calif. question- do we need a permit to highbank on private property? thanks for any info and the help.

If they own the land they may still not have mineral rights. If they do have mineral rights then I think you may not need a permit, but I am not familiar with laws that pertain to highbanking in various parts of CA. Maybe someone who is more knowledgeable on the subject will give some better advice. _________________ If first you don't succeed... |

To the best of my knowledge, you only need a permit to dredge, and if your on private land or BLM its the same. dredging is a permit required on public land. Grubstake And there is also a season for dredging. It all depends on where the runoff will go to.
If the muck and muddy water is caught inside of a basin, and does not run back into a creek, in most cases, a dredge permit isn't needed.
However, if the muddy water and tailings empty back into a river, creek, lake, or other watershed, you would need a dredging permit, public or private land notwithstanding.
In some counties in California, Oregon, Colorado, dredging may not be permitted at all. Sucking water out of a stream is not considered dredging unless the muck flows back into the stream at the time of use, or several days after. _________________ STUDY, And be FREE from the BONDS of IGNORANCE! |
